Welcome to POET.com. These Terms of Use (“Terms”) apply to your use of this website and other POET websites or online services that link to these Terms (collectively, the “Site”).
The Site is operated by POET, LLC and its affiliates (“POET,” “we,” “us,” or “our”).
By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Other Terms May Apply
These Terms govern your use of the Site. Certain POET products, services, accounts, applications, programs, promotions or transactions may have additional or separate terms. If those terms conflict with these Terms, the more specific terms will control for that product, service, program or transaction.

2. Using the Site
You may use the Site for lawful purposes and to learn about or interact with POET and its products, services and programs.

3. POET Content and Intellectual Property
The Site and its content—including text, photographs, videos, graphics, logos, trademarks, software and other materials—are owned by or licensed to POET and are protected by intellectual property laws.
POET gives you a limited, non-exclusive, revocable right to access and use the Site for lawful purposes. This does not transfer ownership of any POET intellectual property to you.
POET's names, logos and trademarks may not be used in a way that suggests sponsorship, endorsement or affiliation without our written permission.
POET, the POET logo, DAKOTA GOLD, NEXPRO, VOILÁ, and JIVE are trademarks or registered trademarks of POET, LLC or its affiliates in the United States and other countries. NASCAR® is a registered trademark of the National Association for Stock Car Auto Racing, LLC. All other trademarks are the property of their respective owners.
4. Information You Provide
If you submit information through the Site, you are responsible for making sure you have the right to provide it and that the information is not intentionally false, unlawful or harmful.
Our collection and use of personal information is described in our Privacy Policy.
Submitting information through the Site does not create an employment, customer, supplier or other contractual relationship with POET unless POET separately agrees to one.
5. Third-Party Links and No Endorsement
The Site may link to websites, services or content operated by third parties. POET does not control those third parties and is not responsible for their content, privacy practices or services. A link does not mean POET endorses the third party.
Political and election-related use. POET and its affiliates do not endorse candidates for elected or appointed government office through this Site. A candidate, campaign, committee, political action committee or other political organization linking to or using POET content does not mean POET sponsors, supports or endorses that person or organization.
6. No Warranties
We work to keep the Site useful and accurate, but information may occasionally be incomplete, outdated or incorrect. POET may change Site content at any time.
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available,” without warranties of any kind, either express or implied.
Nothing on the Site is a guarantee regarding the availability, specifications, pricing, performance or suitability of a POET product or service. Any applicable contract, product specification or other written agreement with POET controls over general information on the Site.
7. Limitation of Liability
To the fullest extent permitted by law, POET and its affiliates, officers, employees and service providers will not be liable for indirect, incidental, special, consequential or punitive damages arising from your use of—or inability to use—the Site, including loss of profits, business opportunities or data.
These limitations do not apply to liability that cannot legally be limited or excluded.

We may also update these Terms. When we do, we will update the “Last Updated” date above and provide any additional notice required by law. Your continued use of the Site after updated Terms take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of South Dakota, without regard to its conflict-of-law rules, except where applicable law requires otherwise.
